Sector Codes
BEE is the strategic framework for economic growth and was always intended to be implementable for each sector of Business in South Africa.
It was therefore of absolute importance that the codes be adapted to suit each idustry, with this goal in
mind Statment 003
was gazetted as part of the Codes of Good Practice for Black Economic Empowerment.
Sector Codes are gazetted in one of three forms:
- Sec 12
- Sec 9 (5), or
- Sec 9 (1)
Section 12 - Transformation Charter
Section 12 Charters are gazetted as a statement of intent by the relevant industy body. A Section 12 Charter:
"refers to the gazetting of Transformation Charters. These are also referred to as Sector Charters, developed
by major stakeholders in the relevant industries, and seek to achieve broad-based transformation"

Section 9 (5) - Draft Sector Codes
Sec 9(5) codes are a set of industry codes that have been presented by the relevant industry body for public comment. They
are not yet enforcable but serve as the framework for the future gazetting of Sec 9(1) Sector Codes.

Section 9(1) - Final Sector Codes
Sec 9(1) codes have been agreed upon and gazetted in their final form after a period of public comment. These codes
stand on equal footing with the the codes of good practice and are used by Verification agents when assesing the
BEE scores of measured entities in the relevant industries.
These codes differ very slightly from the Codes of Good Practice, but must assess the same criteria using the same
definitions. Some calculations have been changed in minor ways, and measurement criteria have been adapted to meet
the needs of the different industries.
Their are currently 4 Final sector codes that have been gazetted.
