A BENEFICIARY OR A TRUSTEE, WHICH COUNTS?

When an organisation uses a Trust as a Special Purpose Vehicle for the Ownership element, points are awarded based on the Beneficiaries and not the Trustees. Still, it qualifies for Ownership points based on who the Black Beneficiaries are that hold the Rights of Ownership through the Trust that are in no way limited.
Ownership measurement is on Black People who have Voting Rights, Economic Interest and Net Value which collectively refer to Rights of Ownership. If the Rights of Ownership is limited in any way, a B-BBEE Rating Agency will not award points.
